A couple of my friends got caught drinking, but the cop did not give one of them a Breathalyzer. So they have no proof she was even drinking. But there trying to charge her with underage drinking. Can they? How will it go down in court? This girl never gets in trouble. Has never been suspended from school. Got ISS once in her hole life. She makes good grades. She passed the test where they made her walk in a straight line. She never told the cop she was drinking. So I don’t think they will or even can charge her with no proof. Help me, please :/
Honestly…yes, but don’t trip because they could never get a conviction. It is standard protocol for most departments to issue a breathalyzer for any1 they suspect of drinking, so he did not follow S.O.P. Second he has no scientific proof. He will have a hard time trying to prove she was drinking with no breathalyzer even though he is a cop it still her word against his.
The officer obviously has information you do not. She THINKS she passed the walk the line test. She does not know if the officer smelled alcohol on her breath. If she got a ticket for possession or consumption of alcohol by a minor … she has been charged.
